1. About these terms
These terms apply when you buy, make an offer for, or use an eligible payment plan to acquire a domain through DNOM. DNOM sells domains from its own controlled portfolio; it is not acting as a marketplace for third-party sellers. References to “DNOM”, “we”, “us” and “our” mean the seller operating dnom.com. You can contact us through the support page.
2. Listings, availability and pricing
A listing is an invitation to place an order, not a binding offer by DNOM. Before accepting an order, we may verify ownership, availability, price and any transfer restriction. Prices are shown in the currency stated on the listing or at checkout. The final checkout summary shows the amount payable, including any applicable discount and taxes that we are required to collect.
If a domain is unavailable, the price is materially incorrect, or we cannot lawfully complete the transaction, we may reject or cancel the order and refund amounts paid for it to the original payment method.
3. Orders and contract formation
You must check the domain, price, contact details and acquisition method before proceeding to payment. Submitting an order authorises our payment provider to take the amount shown, but does not itself mean that we have accepted the order. A binding contract is formed only when DNOM confirms acceptance in writing after payment has been authorised or received.
We may carry out identity, fraud, sanctions, payment and rights checks. We may request reasonable evidence or decline a transaction where a check is not completed satisfactorily. Card and supported digital-wallet credentials are handled by the payment provider and are not stored by DNOM.
4. Offers
An offer submitted by a buyer is binding on the buyer for the period stated with that offer, unless withdrawn before acceptance. DNOM may accept, reject or counter an offer. A negotiated price does not reserve the domain until the parties have agreed the material terms and DNOM has issued written acceptance. Any expiry time and payment deadline included in the acceptance form part of the contract.
5. Buy now and lease to own
A buy-now purchase is payable in full. If lease to own is available, the checkout summary and payment-plan agreement will state the number and amount of payments, billing interval, total price, and consequences of late or failed payment. DNOM retains legal ownership and control of the domain until every payment and other amount due under the plan has cleared. The buyer does not acquire ownership before the final payment clears.
If a lease-to-own payment fails or becomes overdue, DNOM may suspend use of the domain, its nameservers, account access or any future transfer. The buyer has 30 calendar days from the payment due date to bring every outstanding amount fully up to date. If the account remains overdue at the end of that period, DNOM may cancel the lease-to-own contract, recover or retain control of the domain, and return the domain to its portfolio for resale.
Payments made before cancellation are non-refundable and are retained as payment for the buyer’s use of the domain and participation in the lease-to-own arrangement, except where applicable law requires otherwise. Cancellation does not transfer any ownership interest to the buyer. Nothing in this section permits DNOM to take a step prohibited by applicable consumer law.
6. Domain transfer
After acceptance, we will provide transfer instructions. You must provide accurate registrar-account details, complete required identity or account verification, keep the receiving account secure and respond promptly to reasonable transfer requests. Registry or registrar rules, transfer locks, disputes and third-party verification can affect timing.
Transfer is complete when control of the domain has been delivered to the registrar account or other destination agreed with you. Unless the order confirmation states otherwise, ongoing registration, renewal, hosting, email, website and registrar charges after transfer are your responsibility.
7. Final sales, cancellation and refunds
Domain names are unique digital assets. Except where applicable law requires otherwise, every confirmed domain purchase is final and non-refundable, including where the buyer changes their mind, no longer wants the domain, or does not complete the steps needed to receive or use it. Our refund and cancellation policy forms part of these terms.
At checkout, you may ask DNOM to begin transfer or other fulfilment immediately and acknowledge that the transaction is non-refundable once fulfilment has begun, to the fullest extent permitted by law. If you are acting as a consumer, mandatory statutory cancellation rights and remedies remain unaffected. Where the law permits, you may have to pay for work performed before cancellation, and a cancellation right may end once the service has been fully performed with the required consent.
8. Your responsibilities and third-party rights
You are responsible for deciding whether the domain is suitable for your intended use and for obtaining appropriate trademark, regulatory and legal advice. A sale does not grant rights in any third-party trademark, name or content. You must not use a domain unlawfully, fraudulently, or in a way that infringes another person’s rights.
9. Our responsibility
We do not exclude or limit liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. If you are a consumer, nothing in these terms affects your statutory rights.
Subject to those protections, DNOM is not responsible for losses that were not reasonably foreseeable when the contract was formed, for business losses suffered by a consumer, or for delay caused by registries, registrars or events outside our reasonable control. Business buyers may be subject to additional liability terms in an order-specific purchase agreement.
10. Privacy, communications and records
We handle personal information as described in our privacy policy. You agree that order, payment and transfer communications may be sent electronically to the email address you provide. Keep a copy of these terms and your order confirmation for your records.
11. General
If part of these terms is unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive it. You may not transfer your contract before completion without our written consent. We may update these terms for future transactions, but the version accepted with your order governs that order.
Any mandatory consumer protections and rights to bring proceedings in your country of residence remain unaffected. The governing law and courts for a business purchase may also be specified in its order confirmation or purchase agreement.
12. Complaints and support
If something goes wrong, contact us through the support page with your order number. We will review the issue and respond using the contact details supplied with the order.
